Freedom of Information Act (FOIA) / Privacy Act (PA)

Welcome to the Mississippi National Guard's FOIA Requester Service Center and Privacy Office. This Requestor Service Center was designed to assist the public in making FOIA requests for Mississippi National Guard records to include the Air National Guard and Army National Guard. Our office is also available to assist individuals seeking records about themselves under the Privacy Act or to assist in complaints and compliance with the Privacy Act. 

The FOIA, known by its legal cite as Title 5 U.S.C. Β§ 552, along with the Department of Defense (DoD) Regulation 5400.7, governs how FOIA requests will be processed within the National Guard. 


How to file a FOIA or Privacy Request 

Please note that the filing of a FOIA or Privacy request is a personal matter. Military personnel and Federal Government Employees may not use government time or equipment to make such requests.

If you are seeking personal records on yourself under the Privacy Act, you must provide a signed AGO Form 26-R and Standard Form 180 indicating the specific records you are seeking. Based on the existing retrieval practice for the records you are seeking, you may be asked to provide additional information to allow us to retrieve your record. The request, containing your signature, can be mailed, faxed, or scanned and sent as an encrypted e-mail attachment.

Privacy Policy

This web site is provided as a public service by the Mississippi National Guard.

Information presented on this site is not classified and is considered public information and may be distributed or copied. Use of appropriate byline/photo/image credit is requested.

For site management, information may be collected for analytical and statistical purposes. This computer system uses software programs to create summary statistics, which are used for such purposes as assessing what information is of most and least interest, determining technical design specifications, and identifying system performance or problem areas. Except for authorized law enforcement investigations, no other attempts are made to identify individual users or their usage habits. Server logs are scheduled for regular destruction in accordance with National Archives and Records Administration General Schedule 20.

For site security purposes and to ensure that this service remains available to all users, this computer system employs software programs to monitor network traffic, to identify unauthorized attempts to upload or change information, or otherwise cause damage.

Unauthorized attempts to deny service, upload information, change information, or to attempt to access a non-public site from this service are strictly prohibited and may be punishable under Title 18 of the U.S. Code to include the Computer Fraud and Abuse Act of 1986 and the National Information Infrastructure Protection Act.

No FEAR Act

The National Guard Bureau Equal Employment Opportunity Data Posted Pursuant to the No FEAR Act.

The Notification and Federal Employee Anti-discrimination and Retaliation Act of 2002 (the No FEAR Act or the Act), Section 301, requires each federal agency to post summary statistical data pertaining to complaints of employment discrimination filed against it by employees, former employees and applicants for employment under 29 C.F.R Part 1614. 

The specific data to be posted is as described in section 301(b) of the Act and 29 C.F.R. 1614.704. The required summary statistical data for EEO complaints filed against the National Guard Bureau is provided. 

Additionally, the No Fear Act, Section 302, requires the agency National Guard Bureau to post government-wide, a summary of the statistical data relative to hearings requested under 29 C.F.R. Part 1614 and appeals filed with EEOC. 

The posted data is as specified Section 302(a) of the Act and 29 CFR 1614.706 and provided below. The posting of EEO data on agency public websites is intended to assist Federal agencies, Congress, and the public to review whether the agency specific to subject required reporting are in compliance with the equal employment opportunity responsibilities and in compliance with law and regulations. 

The National Guard Bureau posting consists of the aggregate total of state and U.S. territory activity under the purview of the Departments of the Army and Air Force, and the National Guard Technician’s Act of 1968. The total numbers posted are the aggregate sums of the agency and sub-elements.
